We are GLOBAL Pharmaceutical & Nutraceutical ("Company," "we," "us," "our"), a company registered in India at FIRST, 116, S ONE, CHANDLODIYA GHATLODIA RAILWAY ROAD, AHMEDABAD, Gujarat 382481, India.

These Legal Terms form a legally binding agreement between you, whether personally or on behalf of an entity ("you"), and GLOBAL Pharmaceutical & Nutraceutical. By accessing the Services or placing an order, you confirm that you have read, understood, and agree to be bound by these Legal Terms. If you do not agree, you are prohibited from using the Services and must discontinue use immediately.
When placing an order, you must confirm via a mandatory checkbox that you are 18 years of age or older, as required by the Indian Penal Code and applicable regulations for purchasing pharmaceutical products. If you are under 18, you may not use the Services or place orders, and any attempt to do so will result in order cancellation and deletion of any collected data. You are solely responsible for ensuring compliance with this age requirement, and we are not liable for any misrepresentations regarding your age.

The Services include online and call center-based ordering of pharmaceutical and nutraceutical products. They are not intended for use in jurisdictions where such use violates local laws. Users are responsible for ensuring compliance with local regulations.

4. Products
We strive to accurately display product details, but do not guarantee accuracy of images or descriptions. Products are WHO GMP-certified (pharmaceuticals) or FSSAI-compliant (nutraceuticals, sourced from third parties). Products are subject to availability, and we may change prices or discontinue items without notice.

You must provide accurate purchase information. Sales tax and shipping fees may apply, with shipping charges determined based on weight and distance. These charges will be communicated to you by our team before dispatch and added to the order cost. Payments are in INR, charged upon order placement for online payments. For COD orders, payment is due upon delivery, including any applicable shipping charges. We may correct pricing errors or refuse orders at our discretion, including those from resellers.
6. Shipping Policy
Shipping charges are applicable based on the weight of the products and the delivery distance, and will be communicated to you by our team before dispatching the medicine. For Ahmedabad, Durgapur, we deliver medicines same or next day, subject to availability. For non-local users, we provide tie-up pharmacy details, and you must collect medicines from them. If couriers are used, you assume risks of delays, loss, or damage. We are not liable for courier issues, additional shipping costs due to third-party actions, or failure to collect from pharmacies. For assistance, use the Contact Us form, but resolution depends on third parties.
7. Cancellation and Return Policy
We are committed to customer satisfaction. Below are the processes for cancellations, returns, and refunds.
7.1 Cancellation
Orders cannot be canceled directly. To request cancellation, submit a request via the Contact Us form at https://www.globalpharmaceuticals.co.in/contactus or call +91 9332088518 before the order reaches “dispatch status.” Cancellations are at our discretion and not possible post-dispatch. You are responsible for verifying order status promptly.
7.2 Return Process
We strive to ensure you receive quality products in the right condition. If you need to return a product, follow these steps:

Verification Process
Our customer care team will verify your return request within 72 business hours of receiving the complaint. We will assess the validity of your claim (e.g., defective or damaged products).
Eligibility for Return
If your claim is verified as genuine and reasonable, we will initiate a reverse pickup of the product(s). Returns are not accepted for reasons other than defects or damage (e.g., change of mind).
Packaging Requirement
You must return the product(s) in their original manufacturer’s packaging, including all accompanying items (e.g., labels, invoices, leaflets). Failure to comply may result in rejection of the return request.
7.3 Refund Process
If your refund claim is found to be valid after verification, the refund will be processed as follows:
Refund Timeline
Refunds will be processed within 30 days from the date of reverse pickup, if applicable.
For Orders Paid via Online Payment (Credit/Debit Card, UPI, Wallets)
The refund amount will be credited back to the original payment method or respective wallet, as per PayU refund guidelines. This process may take up to 30 working days.
For Cash on Delivery (COD) Orders
The refund will be processed through a bank transfer to your bank account. You will be required to share necessary bank details (e.g., account number, IFSC code) via the Contact Us form to initiate the refund. You are responsible for providing accurate details, and we are not liable for delays or errors in refund processing due to incomplete or incorrect information.
We reserve the right to reject refund requests if the return does not meet our eligibility criteria. You bear the cost of return shipping unless the issue is due to our error.
8. Prohibited Activities
You may not:

12. Term and Termination
These Legal Terms apply while you use the Services. We may deny access or terminate your use at our discretion for any reason, including breaches (e.g., false prescriptions, underage use). Terminated users may not re-access the Services.
13. Modifications and Interruptions
We may modify or discontinue the Services without notice. We are not liable for losses from interruptions or discontinuance.
14. Governing Law
These Legal Terms are governed by Indian laws. Disputes will be resolved in the courts of Ahmedabad, Gujarat, with exclusive jurisdiction.
15. Dispute Resolution
Informal Negotiations
Disputes must be negotiated informally for 45 days via the Contact Us form.
Binding Arbitration
Unresolved disputes will be arbitrated under the Arbitration and Conciliation Act, 1996, in Ahmedabad, with one arbitrator, in English, under Indian law.
Exceptions
Intellectual property, privacy, or injunctive relief disputes will be resolved in Ahmedabad courts.
16. Corrections
We may correct errors in the Services without notice.
17. Disclaimer
The Services and products are provided “AS IS” without warranties, except as stated in the Product Warranty section. We are not liable for errors, interruptions, or damages from use, including product misuse, failure to follow medical advice, or third-party actions (e.g., pharmacies, couriers).
18. Limitations of Liability
We, our directors, or employees are not liable for any direct, indirect, or consequential damages from using the Services or products, including lost profits, data, or health impacts due to misuse.
19. Indemnification
You agree to indemnify us against claims or losses from your use of the Services, breach of these Legal Terms, or violation of third-party rights, including product misuse or false prescriptions.
20. User Data
You are responsible for data transmitted to the Services. We are not liable for its loss or corruption.
21. Electronic Communications
You consent to electronic communications, satisfying legal requirements for written records.
22. Third-Party Websites and Content
The Services may link to third-party services (e.g., tie-up pharmacies, Google Ads, Wix hosting, PayU), which may involve sharing your data. We are not responsible for third-party content, privacy practices, or actions, including delays, losses, or damages by pharmacies, couriers, PayU, or Wix. Use third-party services at your own risk, and review their terms and policies.
23. Force Majeure
We are not liable for delays due to events beyond our control (e.g., natural disasters, pandemics, regulatory actions).
24. Regulatory Compliance
Our pharmaceuticals are WHO GMP-certified, and nutraceuticals are sourced from FSSAI-compliant third parties. Our internal team verifies prescriptions for compliance with the Drugs and Cosmetics Act, 1940, through licenses under Forms 20 and 21B for retail and wholesale drug sales. We do not currently adhere to CDSCO-specific audits but comply with applicable Indian laws. You must comply with local laws, including obtaining valid prescriptions, and are liable for any misuse or non-compliance.
25. Product Warranty
We assure that all products are authentic, WHO GMP-certified (pharmaceuticals), or FSSAI-compliant (nutraceuticals) at sale. This assurance is limited to product condition at delivery and excludes damages from misuse, improper storage, or expiration. Claims for defects must be reported within 7 days via the Contact Us form. We may replace defective products or issue a refund at our discretion. No other assurances or warranties, including merchantability or fitness for a particular purpose, are provided.
